Terms of Service for Restaurants
These Terms of Service govern the use of Tavelo by restaurants and other hospitality businesses. They apply only to businesses, not to consumers. Price schedule: PRICES-2026-10-v1 (section 9).
This English version is a convenience translation. The German version is legally controlling; in case of any conflict, the German version prevails.
1. Provider and scope
The provider is Luis Angel Romero Castillo, an individual trading under the name "Tavelo", Bremgartnerstrasse 118, 8953 Dietikon, Switzerland, support@tavelo.ch ("Tavelo"). The contracting party is the restaurant or its owner ("Restaurant").
Deviating terms of the Restaurant apply only if Tavelo agrees to them in writing.
2. Conclusion of contract, trial and paid use
The collaboration starts with a 30-day trial under a separate trial agreement. During the trial, the Tavelo transaction fee is 0% and the Marketing fee is CHF 0.00.
The trial ends automatically. It does not silently convert into a paid contract.
Paid use starts only when the Restaurant expressly accepts these Terms and the price schedule — by signature or by a clear email naming the accepted documents and versions. Tavelo activates billing only from the agreed start of paid use.
3. Services
Tavelo is software provided as an online service. Depending on the agreement, it includes: ordering by QR code or NFC at the table, staff dashboard, kitchen and bar display (KDS), table and menu management, analytics, loyalty programmes with email one-time codes, digital loyalty cards for Apple Wallet and Google Wallet, Marketing offers through those cards, reservations with reservation emails and — where enabled — AI features (reservation assistant, translations).
Tavelo does not process guest payments or payment card data. Payment takes place between guest and Restaurant; staff mark orders as paid in Tavelo.
Tavelo develops the service further and may change it. Tavelo announces material restrictions of functions the Restaurant actively uses at least 30 days in advance.
4. Accounts and access security
The Restaurant provides truthful information during setup and keeps it up to date.
Staff accounts are personal. The Restaurant assigns roles appropriately, promptly removes access for departing staff and keeps credentials secret. Actions taken through the Restaurant's accounts are attributed to the Restaurant.
The Restaurant reports suspected account misuse to support@tavelo.ch without delay.
5. Restaurant obligations
- Content: the Restaurant is responsible for all content it publishes through Tavelo, in particular menu, prices, allergen and product information, images, logos, offers, rewards and Marketing messages, and for their lawfulness (e.g. price indication, food information, fair-trading law).
- QR codes and NFC: the Restaurant places the table codes, checks them regularly for damage or tampering and reports anything unusual.
- Guest communication: the Restaurant is responsible for lawful communication with its guests and informs them about its own data processing.
- Operations: the Restaurant keeps a fallback for outages (e.g. taking orders at the table).
6. Loyalty programmes and Wallet
The Restaurant defines its loyalty programme and rewards and is responsible for them towards its guests. Points are credited only for orders marked as paid in Tavelo.
Apple Wallet and Google Wallet are services of Apple and Google. Their availability and functioning depend on those providers. Apple and Google do not sponsor or endorse Tavelo or the Restaurants' loyalty programmes.
7. Marketing
Marketing offers are delivered only to guests who voluntarily and expressly agreed to receive the Restaurant's offers through their loyalty card. Tavelo manages consent and withdrawals and re-checks them immediately before each send.
The Restaurant is responsible for the content and lawfulness of its campaigns. It must not record or claim consent it does not have and must not send misleading offers.
8. Reservations
Tavelo sends reservation emails on behalf of the Restaurant. The Restaurant is responsible for confirming, managing and honouring its reservations. Email delivery depends on the email provider; Tavelo automatically retries failed sends but does not guarantee delivery.
9. Prices and payment (price schedule PRICES-2026-10-v1)
- Trial (30 days): transaction fee 0%, Marketing CHF 0.00 per recipient.
- Transaction fee after acceptance of paid use: 1% of the value of each order marked as paid in Tavelo. The basis is the order value recorded in Tavelo for the paid order.
- No transaction fee is charged for orders that are accepted or completed but not marked as paid, or for cancelled orders.
- If an order's paid marking is reversed in Tavelo, the fee charged on it is credited, where applicable in a later billing period.
- Marketing after acceptance of paid use: CHF 0.10 per successfully sent recipient. A recipient counts as successfully sent when Apple or Google has accepted the offer update for that guest's loyalty card. Tavelo cannot confirm that a guest saw the message. Failed, skipped, opted-out or cancelled recipients are not charged; each recipient at most once per campaign. Before each campaign Tavelo shows the maximum amount, which the Restaurant confirms.
- The Marketing price is fixed when a campaign is confirmed and acts as a maximum: a campaign confirmed during the trial costs CHF 0.00 per recipient, even if it is delivered after the trial or after paid use has started. Recipients delivered during the trial always cost CHF 0.00. The trial is the trial period recorded in Tavelo for the Restaurant; it ends when paid use starts. Outside the trial, the price of CHF 0.10 applies, even while billing is paused.
- VAT: Tavelo is not currently registered for Swiss VAT and charges no VAT. If Tavelo becomes liable for VAT, it will give at least 60 days' notice; any resulting price increase is treated as a price change under "Price changes".
- Invoicing: monthly in arrears in CHF, based on the billing data in Tavelo. Payable within 14 days of the invoice date.
- The Restaurant raises objections to an invoice in writing within 30 days of the invoice date.
10. Price changes
Tavelo may change prices with at least 60 days' notice by email. Price changes apply only to orders and Marketing deliveries from their effective date, never retroactively. If the Restaurant does not agree to a price increase, it may terminate the contract with effect from the date the change takes effect.
11. Availability and third parties
Tavelo aims for high availability but does not owe uninterrupted operation. Tavelo announces maintenance where possible.
Tavelo uses third-party providers (hosting, database, email, Apple Wallet, Google Wallet, AI). Their outages or changes can affect the service. Tavelo selects and integrates these providers with due care.
12. Acceptable use
The Restaurant must not use Tavelo unlawfully, upload content that infringes third-party rights, send unsolicited or misleading messages, attempt to access other restaurants' data, probe, circumvent or overload security, or resell the service without agreement.
13. Suspension
Tavelo may suspend access in whole or in part if the Restaurant materially breaches these Terms, if invoices remain unpaid 30 days after the due date despite a reminder, or if suspension is necessary to avert a security risk. Tavelo informs the Restaurant and limits the suspension to what is necessary.
14. Term and termination
The paid contract runs for an indefinite period. Either party may terminate it with 30 days' notice by email. The right to terminate for good cause is reserved.
Fees accrued up to the end of the contract are invoiced.
15. Data export and account closure
After the contract ends, the Restaurant may request an export of its data within 30 days (menu, orders, reservations, customer, loyalty and consent data). Tavelo currently performs export and deletion manually on request. Tavelo then deletes or anonymises the data in accordance with the Data Processing Agreement, subject to statutory retention obligations (e.g. for billing records).
16. Data protection
For guest data that Tavelo processes on behalf of the Restaurant, the Data Processing Agreement (https://tavelo.ch/dpa) forms part of these Terms. Otherwise, the Privacy Policy (https://tavelo.ch/privacy) applies.
17. Intellectual property and third-party rights
All rights in the Tavelo software remain with Tavelo. The Restaurant receives a non-exclusive, non-transferable right of use for the term of the contract.
The Restaurant keeps the rights to its content and grants Tavelo the rights needed to provide the service (storage, display, translation). The Restaurant warrants that it holds the necessary rights to uploaded images, logos and texts and indemnifies Tavelo against third-party claims based on that content.
18. Warranty
Tavelo provides the service with due care. Tavelo does not warrant that the service is always error-free and uninterrupted or that it meets all of the Restaurant's requirements. The Restaurant reports defects promptly; Tavelo remedies reproducible defects within a reasonable time.
19. Liability
Tavelo is liable without limitation for damage caused intentionally or through gross negligence, and for personal injury.
Otherwise, Tavelo's liability is excluded to the extent permitted by law, in particular for slight negligence, for indirect and consequential damage such as lost profit, for outages or changes of third-party providers, and for data loss the Restaurant could have avoided by a timely export. Liability for auxiliary persons is excluded to the extent permitted by law.
20. Changes to these Terms
Tavelo may change these Terms with at least 30 days' notice by email. If the Restaurant objects, it may terminate the contract with effect from the date the change takes effect. Price changes follow "Price changes".
21. Final provisions
Swiss law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction is Zurich, Switzerland, to the extent permitted by law.
If any provision is invalid, the remainder of the contract stays valid.
These Terms exist in German, English and Spanish. The German version is controlling; translations are for information only.
